CLIENT WAIVER/ASSUMPTION OF RISK AND REFUND POLICY
For coaching calls and packages
Please note that when you purchase a coaching call or package, you do so knowing and agreeing to the following:
DESCRIPTION OF SERVICES
Client retains Coach/Company to perform the following services:
Dates and times of all calls will be mutually agreed upon by Coach and Client, scheduled using the Coach’s online scheduling site. In the case of a package that includes multiple calls, the calls will be scheduled within the time frame specified by the Coach, (for example, in a “See the Forest for the Trees Package”, the second call must be scheduled within 10 days from the first call.)
Coaching calls will be conducted using Skype to Skype calling (call only; no video). Client agrees to have an active Skype account and to provide Skype contact information to the Coach prior to the date of the first call.
Email will be used by the Coach to send call summaries and, if included as part of a particular package, to provide encouragement, personalized tips, techniques, strategies and resources to the Client in between coaching calls.
If a package includes email support, the Coach will respond to emails from the Client during the following business hours: weekdays (excluding US Federal holidays) from the hours of 7 am to 6 pm US Mountain Time Zone. While there is not a specific limit set for the number of emails a Client may send, the Coach reserves the right to notify the Client if she believes that the number or content of the issues and concerns sent via email would be more suited to a coaching call or coaching package.
DESCRIPTION OF RELATIONSHIP AND RESPONSIBILITIES OF PARTIES
Responsibilities of Coach/Company:
The Coach is trained to use her communication skills and coaching tools to support the Client as an equal partner throughout the coaching process. Coach will guide the coaching sessions based on the information provided to her by the Client, whether through questionnaires, conversation or written correspondence including email. Client understands that the Coach is neither a therapist or a medical professional.
Responsibilities of Client:
Client agrees to show up for his or her sessions ready and willing to be coached or to indicate to the Coach that he/she is not prepared to be coached at that time. Client takes full responsibility for his or her physical, emotional and mental health. Client acknowledges that he or she is ultimately responsible for all decisions made during the coaching relationship.
In the event that Client is in therapy or under the care of a mental health professional, Client agrees to notify and consult with the mental health care provider with respect to the decision of whether to work with a coach.
FEES AND PAYMENT TERMS
Client agrees to pay the advertised fee for services. All fees are due in advance of services, payable via PayPal.
To receive a refund, the Client must request the refund in writing prior to the day/time of the first scheduled coaching call. After the day/time of the call (in a package, the 1st scheduled call of a package), no refunds will be given.
CANCELLATIONS and NO SHOWS
If a coaching call must be cancelled and/or rescheduled for any reason by either the Client or the Coach/Company, the person needing to cancel must use the online scheduling site to do so prior to the day/time of the call, OR must notify the other party by email or Skype message as soon as possible prior to the day/time of the scheduled call. Any cancelled or rescheduled calls must be rescheduled to take place within 3 business days of the previously scheduled call. If the Client is unable to reschedule the call within that 3-day time frame, the Client must contact the Coach in writing requesting an extension of that time frame. Otherwise, the call will be forfeited and no refund will be given.
In the event of a ‘no-show’ by the Client (defined for this purpose as not answering the Skype call at the scheduled appointment time and not attempting to contact the Coach about any difficulties connecting to the Skype call within 10 minutes of the scheduled appointment time), the call will not be rescheduled and a refund will not be given.
Since there are many factors solely within the Client’s control that can affect the outcome of this or any coaching program, Coach/Company makes no guarantee or promise that Client will achieve any results in the services described herein. Client further understands and agrees that s/he is fully responsible for his or her well-being during and after coaching calls, including all choices and decisions made by Client. Client understands that the Coach’s comments and ideas are to be construed as suggestions and information only, and that Client has full responsibility of making an informed decision and giving his/her informed consent.
WAIVER OF LIABILITY and ASSUMPTION OF RISK
By agreeing to purchase a call or coaching package, Client here and forever agrees to release, indemnify, discharge and hereby hold harmless Coach/Company and its respective agents, representatives, heirs, assigns, contractors, and employees from any and all claims, demands, damages, losses, rights of action or causes of action, liabilities, and/or expenses, present or future, arising out of, or connected with, participation in the Program, without limitation, which may occur as a result of following advice tendered and released, or training rendered. Client further declares and represents that no promise or inducement been made to enter into this agreement.
The client also voluntarily, at his/her own risk, agrees to participate in the coaching call, and for the opportunity to receive coaching and instruction from Joyce Mabe or the Company’s employees at the Company’s facilities or property and/or to engage in the activities included in the Program.
The client further agrees to release, indemnify and hold harmless the Company, its employees, agents, representatives, successors, from and against any and all liability incurred as a result of, or in any manner related to, my participation in the coaching activities.
